GENERAL TERMS AND CONDITIONS OF SALE BY MEANS OF AN INTERNET SITE BETWEEN A BUSINESS AND A CONSUMER

These general terms and conditions of sale are signed on the one hand by PEUGEOT SAVEURS SNC, a company with a capital of 3 554 000 euros of which the registered office is located in Quingey (25440) in France, registered with the trade and companies register of Besançon under the number RCS676180169, hereinafter referred to as PEUGEOT SAVEURS SNC and on the other hand, any physical individual, referred to hereinafter as “the Customer” who wishes to make a purchase via the internet site https://eu.peugeot-saveurs.com/en_eu/ (hereinafter referred to as the “online Store”) of PEUGEOT SAVEURS SNC. The online Store is for selling its products (hereinafter referred to as the “Products”) to Internet users, end-user consumers and private individuals who are browsing the online store (hereinafter referred to as “Users”). Purchases made for the purposes of reselling the Products are not permitted. Consequently PEUGEOT SAVEURS SNC reserves the right to refuse any order for Products which might look like it is for reselling the Products. For the purposes of these General Terms and Conditions of Sale, it is agreed that the User and PEUGEOT SAVEURS SNC will be collectively referred to as the “Parties” and individually referred to as the “Party”, and that the User will be referred to as the “Buyer” once it has validated an order. The rights and obligations of the User must also apply to the Buyer.
The General Terms and Conditions of Sale specify, in particular the terms and conditions of order, payment, delivery and management of any return of Products ordered by the Buyer that there may be.
PEUGEOT SAVEURS SNC and the Customer agree that these General Terms and Conditions of Sale apply to the exclusion of any other conditions, and in particular the general terms and conditions of sale of the PEUGEOT SAVEURS SNC catalogue in its paper format which do not apply to on-line sales or of those applicable for sales in-store or through other distribution and marketing channels.
The General Terms and Conditions of Sale can be viewed at any time in the online Store and as appropriate prevail over any other contradictory document.
The User declares having read these General Terms and Conditions of Sale and having accepted them by ticking the box provided for this purpose before starting the ordering process online as well as the General Terms and Conditions of Use of the Online store.
Any order validated by the User is deemed to be a contract of sale and acceptance of all the provisions of these General Terms and Conditions of Sale.
These General Terms and Conditions of Sale may be subject to subsequent amendments, the version which is applicable to the purchase by the Buyer will be that which is in force in the online Store when the order is placed.
Unless proved otherwise, the data saved in the computer system of PEUGEOT SAVEURS SNC forms the proof of all the transactions concluded with the Buyer.
The User declares that he or she is 18 years of age or over and has full legal capacity. Otherwise, any visits to the online Store and the Products are the responsibility of his legal representative. This legal representative is required to comply with these provisions. In any event, when the personal details are provided, the legal representative must complete the registration form himself or expressly authorise the minor to fill out the said form, in which case the provisions relating to personal data under Article 11 below shall then apply.
The Buyer acknowledges having the ability required to enter into a contract and purchase the Products which are on sale in the online Store.
Any order of a Product on sale in the online Store implies that these general terms and conditions of sale (“hereinafter referred to as “General Terms and Conditions of Sale”) have been expressly read and accepted, without however this acceptance requiring the handwritten signature of the User. Please read the General Terms and Conditions of Sale carefully each time you place a new order.
It is pointed out that no guarantee can be given that correspondence will remain secret on the Internet network and that it is up to each Internet user to take all appropriate measures for protecting his own data and/or software from possible contamination by viruses circulating on the Internet.
2.1. Products
The Products placed on sale by PEUGEOT SAVEURS SNC are those which are contained in the online Store, when the User visits the on-line Store. They are on sale subject to stocks being available.
PEUGEOT SAVEURS SNC presents its Products in the online Store in accordance with article L.111 – 1 of the French Consumer Code, which gives the User the option of finding out the essential features of the Products that he wishes to buy before placing a firm order.
The main features of the Products and illustrations are presented in the online Store.
The choice and the purchase of a Product are the sole responsibility of the User.
The Customer must refer to the description document of each Product in order to find out about the essential features.
The Products on sale are compliant with current French legislation and the standards applicable in France. The photographs in the catalogue are as true to reality as possible but cannot be exactly the same as the product on sale, in particular with regard to the colours. Consequently, PEUGEOT SAVEURS SNC may not be held liable in the event of an error or omission concerning any of the photographs of the Products.
The Product photographs are not contractual.
2.2. Price
The Products will be invoiced on the basis of the price which is current when the order is registered.
Prices are indicated in euros inclusive of VAT (Except all countries outside the European Union : products will be indicated exclusive VAT), excluding delivery costs and are valid for the different delivery zones and countries specified below; it being specified that the value added tax is that which is in force in mainland France on the day when the order was validated.
Prices include any taxes in the country of delivery (Except for all countries outside the European Union : customers will pay local custom taxes) which are applicable on the day of the order and any change to the legal rate of these taxes will be automatically passed on to the price of the Products presented on the site, on the date stipulated by the implementation decree.
Full payment must be made when ordering. At no time, may the sums paid be considered as deposits or down-payments. The prices indicated in the online Store are guaranteed until the limit of validity date which as appropriate is indicated in the offer.
The delivery costs are provided to the Customer in the order summary before the order is validated and are expressed inclusive of VAT. These costs are the responsibility of the Customer and are invoiced in addition to the retail price of the Products.
The payment which the User is asked to make corresponds to the total amount of the purchase, including the aforementioned costs.
The transfer of risks, loss and damage to the Products is effective after the delivery and acceptance of the Products by the Customer.
PEUGEOT SAVEURS SNC reserves the option to change its prices at any time but undertakes to apply the prices shown in the online Store at the time when the User’s order is registered.
PEUGEOT SAVEURS SNC points out that in the event of an incorrect price being displayed, which is clearly ridiculous (very low price) regardless of the reason (computer bug, manual error, technical error.), the order – even if it is validated by the online Store – will be cancelled, and the Customer will be informed of this as soon as possible. The Customer will then have the option, if he so wishes, of replacing his order at the corrected and right price.

Any order signed by the User by means of a “click” constitutes an irrevocable acceptance of the offer from PEUGEOT SAVEURS SNC, which may only be challenged in a limited number of cases stipulated in the General Terms and Conditions of Sale such as in the case of the exercise of the “right of cancellation” or if the products are “out of stock”.
The “click” which is used for authentication and for protecting the integrity of the messages constitutes an electronic signature. This electronic signature has the value between the Parties of a handwritten signature.
The User has the option of cancelling all or part of his order before validating his payment, whether deferred or not.
4.1. Browsing inside the online Store
The User may familiarise itself with the various Products offered for sale by PEUGEOT SAVEURS SNC in the online Store.
The User is free to browse among the various pages of the online Store, without being obliged to place an order. The User may thus browse through the different Product pages and view their key features, their availability, their price as well as the average delivery times available and their costs.
At any time, the User may click on a “Contact” link which allows him to contact PEUGEOT SAVEURS SNC by telephone or email if need be.
4.2. Registering an order
The order displays: the types, descriptions, quantities, availability and prices of the Products selected by the User, the shipping cost incurred (average delivery time and delivery cost) depending on the zone concerned and the country of delivery as well as the total amount inclusive of VAT of the order including the shipping method selected and its cost.
In order to complete the order, the User must follow the following steps:
- Complete the online order form by entering all the references of the selected products. If the order process is left idle for a prolonged amount of time whilst the User is logged on, it is possible that the selection of the products chosen by the User might not be saved. In this case the User is asked to go back to the beginning of the product selection process;
- Check the items in the order and if necessary identify and correct the errors;
- Validate the order, the total price as well as the all-inclusive price;
- Select a delivery type;
- Follow the instructions from the online payment server for paying the all-inclusive price.
4.3 Checking an order
Before validating his order, the User is asked to check his order via a summary of all of the information provided (Products, quantities, prices inclusive of VAT, costs and delivery type, invoice address, delivery address, payment type).
At this point, the User has the option of finalising or cancelling his or her purchase.
The User is asked to read and/or print out the General Terms and Conditions of Sale of PEUGEOT SAVEURS SNC and in particular to read the terms of Cancellation and Returns (see Articles 8 and 9 below).
4.4. Final validation of the order
After having selected and validated his payment and in order to validate his order, the User must confirm to PEUGEOT SAVEURS SNC that he is familiar with and accepts the General Terms and Conditions of Sale by clicking on the box provided for this purpose on the one hand and then clicking on “Validate and pay the order”.
The order is then registered and becomes irrevocable, subject to the related payment being effected. The User becomes the Buyer. His order will be saved on the computer records of PEUGEOT SAVEURS SNC, which themselves are kept in a reliable and durable format, and will be considered as proof of the contractual relationship which has been established between the Parties.
4.5. Confirmation of the order
A summary of the contractual information will be sent to the Buyer by email without undue delay, to the email address which was indicated by the Buyer during the ordering process. This confirmation will contain all of the details which form the contract which has been established between the Parties.
PEUGEOT SAVEURS SNC recommends that the Buyer keep any data relating to the order and the General Terms and Conditions of Sale, which is liable to be amended, on paper or in a reliable computerised format, The General Terms and Conditions of Sale are those which were in force in the online Store on the date when the order was validated.
The Buyer must check the completeness and accuracy of the information which he provides to PEUGEOT SAVEURS SNC. PEUGEOT SAVEURS SNC may not be held liable for any input errors that there may be and for the consequences in terms of delays or delivery errors. In such circumstances, all costs incurred for the reshipment will be the responsibility of the Buyer.
The User receives electronic confirmation of the shipment of the order. The delivery will be made to the delivery address indicated by the User when ordering.
During the completion of the different steps of the aforementioned order, the User undertakes to comply with these contractual terms and conditions in accordance with article 1316-1 of the Civil Code.
The computerised records, stored in computer systems in compliance with safety approved conditions, will be considered as proof of the communications and orders which have occurred between the Parties. The purchase orders and invoices are archived in a reliable and durable format so that they can be produced as proof.
The amount owed by the Buyer is the amount shown on the order confirmation sent by email to the Buyer.
PEUGEOT SAVEURS SNC accepts the following payment types for all orders:
- bank card: Visa, Mastercard, American Express, other credit cards;
- Paypal.
Payments made by bank card are made through the secure 3D Secure system which uses the SSL (Secure Socket Layer) protocol in which the information provided is encrypted by software which means that no third party can have knowledge of it during transit over the network. The transaction is only debited from the User’s bank card once the products have been shipped.
PEUGEOT SAVEURS SNC reserves the right to suspend any order and any delivery in the event of refusal to authorise payment by bank card by any of the officially accredited organisations or in the event of non-payment.
PEUGEOT SAVEURS SNC retains full and entire ownership of the Products which have been sold until all the amounts owed by the Buyer as part of his order have been fully paid, including fees and taxes.
The transfer of ownership of a Product purchased from PEUGEOT SAVEURS SNC by the Buyer to a third party, shall not be the responsibility of the company PEUGEOT SAVEURS SNC. Only the original Buyer of this product may request access to the provisions of the General Terms and Conditions of Sale.
7.1 Delivery
7.1.1 Deliveries:
Deliveries may be made in the zones and countries specified under article 3: Price. Delivery will be made to the address indicated at the time when the order was placed. The User of the online Store will be informed of the types, times and costs of delivery available from PEUGEOT SAVEURS SNC on each Product page.
The delivery will take place by the deadlines indicated on the order confirmation which we send you. The order will be delivered within a maximum of fourteen (14) working days as of the day following the validation by the Buyer of his order unless specially stipulated otherwise to the User before he places the order, and in any event, prior to the final validation of the order. Should this be the case, PEUGEOT SAVEURS SNC will inform the Buyer of the new delivery deadline, and the Buyer may, if he so wishes, cancel his order and/or obtain a refund.
Deliveries cannot be made on Sundays and public holidays. The Buyer can choose from a number of delivery types, indicated below, when he places the order for the Products which are sold by PEUGEOT SAVEURS SNC
Delivery by Colissimo: Delivery to the delivery address indicated by the Buyer when ordering: cost £5.95.
The delivery will be made by a logistics service provider depending on the zone and the country of delivery at the fixed price indicated in the on-line Store. The Buyer must give the precise delivery address and check the completeness and accuracy of the information which he provides to PEUGEOT SAVEURS SNC. PEUGEOT SAVEURS SNC may not be held liable for any input errors that there may be and for the consequences in terms of delays or delivery errors. In such circumstances, all the costs incurred for the reshipment will be the responsibility of the Buyer.
7.2 Unavailable products
In the event a Product not being available, the Buyer will be informed of this at the latest upon the delivery of the order. The Buyer will then have the choice of either asking for a refund of the amounts paid or, as the case may be, for an exchange with a product from the online Store which is equivalent in terms of features and price. In this case, PEUGEOT SAVEURS SNC will cancel the remainder of the unavailable Products and generate a new order in the name of the Buyer which will lead to the issue of a new invoice in replacement of the first one.
Should an exchange not be possible, PEUGEOT SAVEURS SNC reserves the right to cancel the Buyer’s order and to refund the amounts paid.
If the Buyer does not wish to keep the substituted Product, the Buyer will have the option of obtaining a refund for the Product which has been replaced. To do this, the Buyer must return the substituted Product, unused, in its original packaging (for example, box, case) and, if possible, packaged in accordance with the procedure for Product Returns as specified under article 9.
PEUGEOT SAVEURS SNC undertakes to reimburse the Buyer at the latest within thirty (30) days following payment from the Buyer.
PEUGEOT SAVEURS SNC may not be held liable in respect of a Product which is unavailable, and the Buyer shall not be entitled to damages and interest in respect of product unavailability.
7.3 Late delivery
In the event of a delivery made more than three days after the date of the email indicating that the package has been sent to the Buyer, the Buyer must report this delay by e-mail to the following e-mail address: support-france@peugeot-saveurs.com
PEUGEOT SAVEURS SNC will then investigate with the logistics provider. An investigation may last up to 21 working days (excluding Saturdays, Sundays and public holidays) from the date when it was started. If during this period, the Product is found, it will be re-routed immediately to the delivery address indicated by the Buyer. If however the Product is not found at the end of the 21 day investigation period, the package will be considered as lost. At the end of this period, PEUGEOT SAVEURS SNC will resend a replacement product to the Buyer at its own expense.
Should the ordered Product(s) no longer be available at this time, PEUGEOT SAVEURS SNC may offer the Buyer a substitute Product with similar features and of an equivalent price or refund the Buyer in respect of the price of the Products and delivery costs incurred as a result of the logistics provider losing the Product.
7.4 Non collection of the package from the logistics provider
The Buyer is required to collect the package from the logistics provider within the allotted deadline following the attempted delivery by the logistics provider. If the package is not collected by the deadline, the parcel will be returned to PEUGEOT SAVEURS SNC. The Products will then be reshipped to the Buyer at the Buyer’s cost once PEUGEOT SAVEURS has received payment by cheque of the said costs.
7.5 Non-compliance and breakages
7.5.1 incident during receipt of the package:
Upon receipt of his order, the Buyer must make sure that he checks the compliance of the Products received in the presence of the deliveryman. In the event of an abnormality concerning the delivery (Product broken, chipped or missing, packages damaged or missing) the Buyer must without fail:
- Notify clearly on the delivery note the reserves, on the very day of the receipt, in the presence of the deliveryman.
- Inform PEUGEOT SAVEURS SNC of the situation by email to support-france@peugeot-saveurs.com within three days of the delivery by the logistics provider.
Any claim made after this deadline or without there being a reserve indicated on the delivery note will be rejected and PEUGEOT SAVEURS SNC shall not be liable in any way.
PEUGEOT SAVEURS SNC reserves the right to ask the Buyer to return to it the Product concerned in accordance with the “Product Return(s)” procedure set forth under article 9.
If the above conditions are met, PEUGEOT SAVEURS SNC will then either exchange or refund the Product(s) concerned or reship the missing Product (subject to the merits of the Buyer’s claim).
7.5.2 Non-conformity of the products with respect to the purchase order:
The Buyer must submit to PEUGEOT SAVEURS SNC by email to the following address: support-france@peugeot-saveurs.com, on the very day of the delivery or no later than the first working day following the delivery, any claim concerning a delivery and/or non-compliance of the Products in terms of their type with regard to the indications shown on the purchase order. In the event of the Product being returned, the Buyer must comply with the returns procedure described under article 9 hereof.
7.6 Retention of title
In addition, it is specified that the ownership of the Products which have been ordered will only be transferred to the Buyer upon full payment of the invoice price, with this including the delivery costs.
Cooling off period
In accordance with Directive 2011/83/EU of the European Parliament and Council of 25 October 2011 concerning consumer rights and the Order No. 2016-301 of 14 March 2016 and as transposed into the articles L 221-18 and subsequent of the Consumer Code, every consumer is entitled to cancel his order at any time within 14 calendar days following the date on which he received the Item(s) and this without having to provide any reason or pay any penalties.
Under the terms of these General Terms and Conditions of Sale, PEUGEOT SAVEURS SNC wishes to grant the Customer a cooling off period which is extended to 30 calendar days. This cooling off period expires 30 days after the day when the Customer or a third party other than the carrier and who has been appointed by the Customer, takes physical possession of the Order.
The Buyer has thirty (30) calendar days in which to request a refund or exchange via his personal space on www.peugeot-saveurs.com/moncompte. The Buyer may return the Product(s) at his own cost. This period runs from the day following the signing of the contract or from the day of receipt of the Product(s) by the Buyer.
Cancellation procedure
The Buyer must contact us first by email at support-france@peugeot-saveurs.com and return request must be approved by our customer service.
The Buyer returns the new Products in their original packaging, promptly and by post and within a maximum of 30 days as of his decision to cancel, to the following address:

PEUGEOT SAVEURS SNC also recommends that the Buyer send it the shipment advice of the carrier of the Product(s) being returned.
Refund terms:
If the cancellation procedure has been properly followed by the Buyer, PEUGEOT SAVEURS SNC will inform the Buyer when it has received the returned product(s) and will refund the sums paid within a maximum of fourteen (14) days as of the receipt of the returned Products or from when, as the case may be, the Buyer provides it with proof of shipment, with whichever date is the first being the one which applies.
PEUGEOT SAVEURS SNC will refund the price of the returned Products, as well as the delivery costs (at the price of a standard delivery, regardless of the delivery type selected at the time of the order). In the event of the cancellation of a part of the order, PEUGEOT SAVEURS SNC will not refund delivery costs which are charged as a flat-rate per order and not applied per article.
The refund will be made using the same payment type as that which was selected by the Buyer as part of his original purchase, unless expressly agreed otherwise by the Buyer and subject to this not creating any additional costs for the Buyer.
The Buyer may not be held liable in the event of an impairment being caused to the Products as a result of handling operations other than those necessary for establishing the nature and features of the Products as well for checking that they function properly. In this eventuality, PEUGEOT SAVEURS SNC retains the option of offsetting the prejudice suffered by it as a result of such an impairment by deducting a lump sum of 500 Euros from the amount reimbursed in accordance with the procedure described below.
The “Product Return” procedure does not stop the Buyer from exercising his cancellation right (see article 8). It applies in the case of statutory guarantees resulting either from the non-compliance of the Product (s) when ordered (article 7.5) or hidden defects (article 10). It must be exercised within the required time limits in accordance with the following procedures:
Product return procedure
- The Buyer informs PEUGEOT SAVEURS SNC by sending an email to support-france@peugeot-saveurs.com of his intention to return the Product(s);
- PEUGEOT SAVEURS SNC will then reply with a case number and a label to be attached to the return package;
- The Buyer returns the new Products in their original packaging with the PEUGEOT SAVEURS SNC label, together with a cover letter and by post only to the following address:

- PEUGEOT SAVEURS SNC informs the Buyer when it has received the package and carries out the refund or the exchange.
- PEUGEOT SAVEURS SNC reserves the right to ask the Buyer for photos or details before approving the return.
PEUGEOT SAVEURS SNC recommends that the Buyer return the Products by track and trace colissimo with extra insurance, so that if need they are covered up to their market value in the event of spoliation or of the products being lost.
The Buyer is informed that no product (s) may be returned via physical PEUGEOT SAVEURS SNC sales outlets.
PEUGEOT SAVEURS SNC reserves the right to refuse to accept a return which was not notified to it or where the prior instructions were not followed. A return which does not comply with this procedure and during which the package(s) was or were lost during transport may not be accepted by PEUGEOT SAVEURS SNC. In such circumstances no compensation or refund may be demanded by the Buyer as such.
10.1 The legal guarantee
All our products are covered by a statutory guarantee scheme applicable as long as the products were used normally and the recommendations regarding maintenance were followed.
Article L. 217. 4 of the consumer code
The seller delivers a product which complies with the terms of the contract and is responsible for any non-conformities that there may be when it was delivered.
The seller is also responsible for any non-conformities resulting from the packaging, assembly instructions or installation if under the terms of the contract it was responsible for the installation or if such installation was carried out under its responsibility.
Article L. 217-5 of the consumer code
The product is compliant with the contract:
1° If it is fit for the use that would normally be expected of a similar product and, as appropriate:
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer may legitimately expect with regard to the public statements made by the seller, by the manufacturer or by its representative, particularly in advertising or labelling;
2° Or if it has the features which were jointly agreed by the parties or is fit for any special use sought by the buyer, which was brought to the attention of the seller and that the seller accepted.
Article L. 217- 12 of the consumer code
Any legal action resulting from a non-conformity must be taken in the two years following the delivery of the product.
Article 1641 of the civil code
The seller is bound by the guarantee against hidden defects in the product sold that render it unfit for its intended use, or that so impair its use that the buyer would not have bought it, or would only have given a lesser price for it if he had known about the defects.
Article 1648 paragraph 1 of the civil code
An action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect.
Statutory guarantee of compliance:
It is pointed out that as part of the statutory guarantee of compliance, the Buyer – has two years from the delivery of the product to take action with regard to PEUGEOT SAVEURS SNC;
- may choose between the repair or replacement of the Product which has been ordered, subject to the cost conditions stipulated by article L. 211-9 of the consumer code
- is exempted from providing proof of the existence of the non- conformity of the Product during the six (6) months following the delivery of the product. This period is extended to twenty-four (24) months as of 18 March 2016, except for second-hand goods.
The statutory guarantee of conformity applies regardless of the commercial guarantee which may cover the Product.
The Buyer may decide to enforce the guarantee against the hidden defects of the Product sold within the meaning of article 1641 of the civil code. In this case, the Buyer may choose between cancelling the sale or a reduction of the selling price in accordance with article 1644 of the civil code.
In the event of a non-conformity existing at the time of delivery, PEUGEOT SAVEURS SNC undertakes depending on what is possible and reasonable:
- either to replace the Product with an identical product (subject to stocks available);
- or to exchange the Product with a product of an equivalent quality and price (subject to stocks available);
- or to refund the price of the Product within 30 days following the application by the Buyer of the statutory guarantee of conformity, if the replacement with an identical or equivalent Product proved impossible.
Statutory guarantee on hidden defects: PEUGEOT SAVEURS SNC provides a guarantee covering the hidden defects of the sold Product in accordance with the conditions of articles 1641 and subsequent of the civil code.
Four conditions must be met:
- the defect or fault prevents the Buyer from making normal use of the Product;
- at the time of purchase, the Buyer could not detect the defect or fault affecting the Product;
- the defect or fault must not be the result of improper use of the product;
- the Buyer must act within a period of two years as of the day when he discovered the defect or fault, in order for this guarantee to be applicable.
If these four conditions are met, the Buyer has the choice between:
- returning the purchased product and obtaining a refund for the price paid;
- keeping the product and requesting a partial refund of the price paid.
In any event, the liability of PEUGEOT SAVEURS SNC may not exceed the value of the Product(s) purchased.
Commercial guarantee:
The products purchased on the site https://eu.peugeot-saveurs.com/en_eu/ may provide an entitlement in addition to the aforementioned legal provisions, to a contractual guarantee of which the conditions and terms of implementation depend on the products. The implementation terms of this guarantee are described more fully in the documents provided to the Customer when the product is supplied
Exclusion of guarantees:
The guarantees do not apply to faults resulting from the actions of the Buyer, such as for example improper use of the Product or repairs undertaken by itself to the Product.

10.2 Scope of the guarantee
The guarantees granted by PEUGEOT SAVEURS SNC to Customers beyond the statutory guarantee of compliance are as follows:
- Mechanisms – life time guarantee (With the exception of the mechanism of the Isen mill which has a 5 year guarantee from the delivery of the product.)
- The manual mills, 3 years from the delivery of the product.
- The BALTAZ corkscrew, 8 years from the delivery of the product.
The other products or parts not referred to above are subject to the statutory guarantee of compliance.
10.3 Exclusion
In all cases, defects and damage caused by natural wear and tear or external accidents, negligence, poor maintenance, storage in abnormal conditions, improper use of the product , or by any modification to the product which is not allowed or specified by PEUGEOT SAVEURS SNC, are excluded from the guarantee.
Personal information
The personal information which is collected as part of on-line selling, needs to be provided in particular for access to the online Store, for the processing and delivery of the orders, as well as for the preparation of the delivery notes and the preparation of invoices. Information which is collected is processed and stored in accordance with the data protection Act No. 78-17 of 6 January 1978 amended and European regulation no. 2016/679/EU of 27 April 2016 (applicable as of 25 May 2018).
Personal data will only be kept for a long as is required for accomplishing the objective for which it was collected.

For security reasons and to avoid any fraudulent requests, you must provide proof of identity when making this request. The proof will be destroyed once the request has been processed.
Finally, the User is also entitled to refer to the competent administrative authority in case he/she considers that his/her rights have not been respected.
PEUGEOT SAVEURS SNC is liable to send Users or Customers sales offers by post, email, sms, telephone or via any web sites operated by PEUGEOT SAVEURS SNC or on social networks, subject to prior acceptance.
The User or Customer has the option at any time of refusing sales canvassing free of charge, by clicking on the “unsubscribe” link shown in each email.
Neither of the Parties may be considered to have breached their contractual obligations, if the fulfilment of such obligations is delayed, hindered or prevented by an Act of God or force majeure. According to article 1218 of the civil Code force majeure exists in contractual terms if an event beyond the control of the debtor, which could not be reasonably foreseen when the contract was entered into and of which the effects cannot be avoided by appropriate measures, prevents the debtor from fulfilling its obligation. The Party affected by such circumstances will notify the other party within ten working days following the date on which it became aware of the force majeure.
The Parties will then meet, within one month, unless it is impossible to do so due to the force majeure event, in order to examine the effect of the event and agree the terms under which the contract will continue to be performed. Should the force majeure event last for more than three months, the General Terms and Conditions of Sale may be terminated by the wronged Party.
The following events are expressly considered as cases of force majeure or Acts of God, in addition to those which are usually accepted by case law applied by French courts:
- The blocking of means of transport or supply lines, earthquakes, fires, storms, floods, lightning;
- Stoppages caused to telecommunication networks or difficulties which are specific to the telecommunications networks not controlled by the Buyer.
Users commit not to making any use of this content; any total or partial reproduction of this content is strictly prohibited and is likely to constitute an act of counterfeit. Any behaviour found inconsistent will be prosecuted.
Should one or more of the stipulations of the General Terms and Conditions of Sale be judged invalid or declared as such in accordance with a law, a regulation or following a final decision by a competent court, the other stipulations shall retain all their force and scope.
The General Terms and Conditions of Sale and the summary of the order sent to the Buyer form a contractual whole and constitute the entirety of the contractual relationship established between the Parties.
In the event of a contradiction between these documents, the General Terms and Conditions of Sale shall prevail.
These General Terms and Conditions of Sale may be amended at any time by PEUGEOT SAVEURS SNC. Any new version of the General Terms and Conditions of Sale will be made available and indicated on the site of the online Store.
Should these General Terms and Conditions be translated into one or more foreign languages, only the French text shall apply in the event of a dispute.
These General Terms and Conditions of Sale and the contractual relationship resulting from them between PEUGEOT SAVEURS SNC and the Buyer are subject to and governed by French law with the exception of the Vienna Convention on the international sale of goods.
Any disputes which may arise from purchase and sales transactions concluded in accordance with these general terms and conditions of sale, concerning both their validity, their interpretation, their performance, their termination and their consequences and their results and which could not be resolved amicably between the seller and the customer, will be brought before the competent courts in accordance with common law.
The Buyer has the option of using free of charge (except for any lawyers’ and assessment fees) a mediation scheme for reaching an out of court settlement of disputes in accordance with article L. 612-1 of the consumer code Before any mediation the Buyer must submit a written claim directly to PEUGEOT SAVEURS SNC at the following address :

The application for mediation must be made within one year as of this written claim under pain of being inadmissible (Article L. 612-2 1° and 4° of the consumer code) It is in particular recommended to apply to the Consumer Mediation Commission or to existing industry sector mediation bodies which details can be found on the internet site https://eu.peugeot-saveurs.com/en_eu/. Mediation is not mandatory in accordance with article L. 612-4 of the consumer code The Buyer and PEUGEOT SAVEURS SNC are free to accept or refuse the solution proposed by the ombudsman.
Any texts, comments, works, illustrations and images reproduced in the online Store are the exclusive property of PEUGEOT SAVEURS SNC and are protected under copyright as well as intellectual property, which prohibits any use without the consent of PEUGEOT SAVEURS SNC. The establishment of commercial ties which violate the rights of PEUGEOT SAVEURS SNC is strictly forbidden.
For any information, claim or question concerning the terms of sale of PEUGEOT SAVEURS SNC, the online Store or the Products themselves, the User must contact the Site’s Customer Services Department by email using the contact form indicating his order number as appropriate.

- information concerning the statutory and contractual guarantees and their terms of implementation,
- the features of the digital content and if necessary, its interoperability;
- the possibility of using a contractual mediation service in the event of a dispute.
